1. About these terms

These Terms of Service (Terms) form a binding agreement between you and Penrith Valley Regional Sports Centre Limited (we, us, our). They apply when you create an account on, or otherwise use, the PVRSC Members Portal (the Portal).

Please read them carefully. If you don't accept them, don't use the Portal. By signing up, you confirm you've read these Terms and our Privacy Policy and agree to be bound by both.

These Terms apply in addition to (not instead of) any signed centre membership agreement, competition by-laws, or venue conditions of entry posted on premises.

2. Who can use the Portal

You must be at least 13 years old to create your own account. We do not allow self-signup for anyone under 13 — parents or legal guardians can register children under 13 by adding them as a dependant on the parent's account.

If you are 13–17, your account is held in "guardian approval pending" status until a parent or legal guardian confirms via an emailed approval link.

You confirm that the information you provide at signup (and update over time) is accurate, current, and complete. Misrepresenting your age, identity, or eligibility (for example, to play in a comp you don't qualify for) is a breach of these Terms and may result in suspension, forfeit of fees, and removal from the Portal.

3. Your account

  • You are responsible for keeping your password confidential and for all activity on your account. Choose a strong, unique password. We strongly recommend enabling two-factor authentication (2FA).
  • Admin accounts are required to use 2FA — this is a non-negotiable security control given the data and financial actions admins can take.
  • Don't share your account with another person. Each member needs their own account so that eligibility, payments, and audit trails are accurate.
  • If you suspect unauthorised access, change your password immediately and contact office@pvrsc.com.au.
  • We may suspend or terminate accounts that breach these Terms or that pose a safety or security risk, at our reasonable discretion. We'll generally give notice and a chance to respond unless we need to act immediately.

4. Acceptable use

When using the Portal, you agree to NOT:

  • Use it for any unlawful purpose, or breach any applicable law.
  • Harass, threaten, abuse, or stalk other users — within the Portal or in connection with anything that happens on it.
  • Impersonate another person or misrepresent your affiliation with anyone.
  • Upload content that is unlawful, defamatory, obscene, or infringes someone else's rights (including copyright, trade marks, or privacy).
  • Probe, scan, or test the vulnerability of the Portal, or attempt to bypass any security or access control.
  • Use bots, scrapers, or other automated means to access or download data — except as expressly permitted by us in writing.
  • Interfere with the operation of the Portal, or anyone else's use of it.
  • Resell, rent, or commercially redistribute Portal data, content, or accounts.

Breaches may result in immediate account suspension, removal of content, forfeiture of fees, and (where serious) referral to police or other authorities.

5. Competitions, teams, and rosters

By nominating a team or joining a roster, you agree to:

  • Comply with the published competition rules, by-laws, and the captain's roster decisions.
  • Play in the age and category band you're eligible for. If your DOB or sex changes the bands you qualify for, eligibility is decided by our admin team — refusal to accept an eligibility decision may result in withdrawal from the comp without refund.
  • Behave in a sportsmanlike way, respect officials and opposing players, and follow our codes of conduct and the venue's conditions of entry.
  • Captains: take reasonable care to confirm your roster's eligibility (age, gender category, suspensions, financial), to communicate fixture changes promptly, and to act in good faith for your team.

Repeated or serious breaches of competition rules — including ineligible-player use, fielding ringers, falsifying scores, or refusing to pay — may result in match forfeits, ladder adjustments, fines, or removal of the team from the competition. Our admin decisions on competition matters are final unless our written by-laws provide for an appeal process.

6. Fees

The Portal collects fees on our behalf for the activities you participate in. Fees that may apply include:

  • Annual membership fee — currently $40.00 per member, valid for 12 months from the date of payment.
  • Nomination fee — a one-off fee per team to enter a competition, set per-comp and payable at the time of nomination.
  • Team fees — court hire and admin per team. We bill these in one of two ways depending on the competition: a single flat-season fee, or per-game (e.g. $100 per game across the season). The basis is shown on the comp's page before you nominate.
  • Finals fees — issued separately if your team makes the finals and the comp charges for finals.
  • Forfeit fines — payable by a team that forfeits a fixture. The fine replaces the game fee for that fixture (the opposing team is not billed the game fee for a fixture that was forfeited against them).
  • Withdrawal charges — payable by a team that withdraws mid-season, if applicable to the comp.

Per-comp prices are shown before you commit to a payment. Fees are payable in Australian dollars and are GST-inclusive where GST applies.

7. How to pay

We offer four payment routes:

  • Online card payment via Stripe — Visa, MasterCard, AmEx. Processed by Stripe Payments Australia Pty Ltd; we never see your card details. A surcharge of 1.70% + 0.30c per transaction applies, which represents the actual cost of processing the card. The surcharge is shown on the checkout screen before you confirm payment, in compliance with the Australian Competition and Consumer Commission's surcharging rules.
  • Bank transfer to PVRSC, BSB 032-271, account 156433. Please include your team name + invoice reference so we can match the payment.
  • At the counter during Mon–Fri 9am–8pm. EFTPOS, cash, or card.
  • Pay on the night — at the venue immediately before your fixture, if your captain has arranged this with admin.

You agree to pay all fees by their due date. Unpaid fees may result in suspension from play (your team can't take the court until paid up), forfeit of fixtures, debt-recovery action, or referral to a collections agency. We may also charge reasonable costs we incur in recovering an unpaid amount.

8. Refunds and cancellations

Our refund position aims to be fair to both the participant and the centre's operational reality. Our obligations under the Australian Consumer Law (set out in section 11) override anything in this section to the extent of any inconsistency.

If we cancel a competition or fixture

  • If we cancel a competition before it starts (e.g. not enough teams), we'll refund nomination fees and any team fees you've already paid for that comp in full.
  • If we cancel a fixture and don't reschedule it, the per-game team fee for that fixture is credited back. For flat-season comps, a pro-rata credit is at our reasonable discretion.
  • If we cancel for reasons outside our control (e.g. court closure, public health order), we'll either reschedule the fixture or credit fees on a pro-rata basis.

If you withdraw

  • Before season start: nomination fees are non-refundable once a team is approved into a comp (we've committed your slot in the draw). Team fees you've paid in advance are refundable, less any administrative or transaction costs we've actually incurred.
  • After season start: previously-paid team fees for completed and scheduled-but-not-yet-played games are not refundable, except as required by the Australian Consumer Law. A withdrawal charge may apply per the comp's published rules.
  • Membership fees: non-refundable except as required by the Australian Consumer Law.

Change-of-mind

We are not required to give a refund or replacement if you simply change your mind — Australian Consumer Law does not require this. However, we may offer a goodwill credit at our discretion within a reasonable time after purchase, particularly for membership fees paid within the last 7 days.

How refunds are paid

Approved refunds are returned to the original payment method where possible (card refund via Stripe, or bank transfer back to the originating account). If the original method isn't available, we'll arrange an alternative.

Stripe surcharges

When a refund is processed via Stripe, Stripe does not refund the original surcharge component to us. By default, we refund the full amount you paid (including the surcharge) at our cost. We reserve the right to deduct the surcharge from very large refunds where it would be unreasonable for us to bear it.

9. Suspensions and disciplinary

Players may be suspended from competitions for serious or repeated breaches of competition rules, codes of conduct, or these Terms. Suspensions are recorded on your account and visible to admins (and to you on your dashboard).

Suspension does not entitle you to a refund of fees already paid for the period of the suspension. If you contest a suspension, contact us as set out in section 15.

10. Content you provide

You retain ownership of the content you upload to the Portal (profile photo, free agent bio, team name, score-sheet entries). By uploading it you give us a non-exclusive, royalty-free, world-wide licence to use, store, and display that content for the purpose of operating the Portal and providing the service to you and your team.

You confirm that any content you upload is yours to upload — for example, you took the photo, or you have the right to upload it on behalf of someone else (such as your child as their parent or guardian). We may remove content that breaches these Terms or that we reasonably believe infringes someone else's rights.

Team names, free agent bios, and any other free-text content must not be obscene, harassing, defamatory, or include private information about other people without their consent.

11. Liability and consumer rights

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure of services, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services rendered with due care and skill, and to be fit for the purpose for which they are commonly supplied.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law that cannot lawfully be excluded.

To the maximum extent permitted by law (and subject to the above):

  • The Portal is provided "as is". We don't warrant that it will be uninterrupted, error-free, or that defects will be corrected.
  • We are not liable for indirect, consequential, or special losses, including loss of profits, loss of opportunity, or loss of data, arising out of your use of the Portal.
  • Our total liability to you in any 12-month period in connection with the Portal is limited to the fees you've paid us in that period (other than where the law requires a different cap).

Recreational activity — sport on the court. Playing organised sport involves inherent and obvious risks of physical injury. By participating in our competitions or programs (whether arranged via the Portal or otherwise) you acknowledge these risks. To the maximum extent permitted by Part 1A of the Civil Liability Act 2002 (NSW), we and our staff are not liable for personal injury suffered as a result of materialisation of an obvious risk inherent in the recreational activity. This does not limit your rights under the Australian Consumer Law against us as a supplier of services.

12. Indemnity

You agree to indemnify and hold us harmless from any third-party claims, costs, damages, or losses (including legal costs on a solicitor-and-own-client basis) arising out of (a) your breach of these Terms, (b) your breach of any law, or (c) content you submit to the Portal that infringes someone else's rights. This indemnity does not apply to the extent the claim arises from our own negligence or wilful misconduct.

13. Privacy

How we handle personal information is set out in our Privacy Policy, which forms part of these Terms. Read it carefully — in particular the sections on children and minors, photos, and your access and correction rights.

14. Marketing communications

By creating an account as an adult (18+), you agree to receive occasional marketing emails from us — news about new competitions, programs, events, and our newsletter. We don't make you tick a separate box at signup; agreement to these Terms is the agreement. Under the Spam Act 2003 this is treated as consent for the duration of our active relationship.

For accounts of children under 18, no marketing emails are sent unless the parent or guardian has explicitly ticked the marketing opt-in on the guardian-approval page (or later on the child's profile). The default for minors is opt-out.

You can opt out at any time:

  • By unticking the marketing preference on your profile, or
  • By clicking the one-click unsubscribe link in any marketing email we send.

Opting out of marketing does not affect transactional or safety messages (account verification, password reset, fixture changes, payment receipts, suspension notices). Those continue while you have an active account. The third-party marketing platform we currently use, along with the limited fields we share with it, is disclosed in section 4 of the Privacy Policy.

15. Changes to these Terms

We may update these Terms from time to time — for example, to reflect new features, fee changes, or law changes. We'll post the updated Terms on this page and update the "Last reviewed" date at the top. For material changes (e.g. new fees, removed rights), we'll also notify active members by email or via an in-app notice the next time you log in. Continued use of the Portal after the updated Terms have taken effect means you accept them. If you don't accept the changes, you can deactivate your account.

16. Disputes

If you have a complaint, please contact us first — most issues are resolved quickly by a conversation. Email office@pvrsc.com.au or phone (02) 47 313 222. We'll acknowledge within 5 business days and aim to substantively respond within 30 days.

If we can't resolve it together, you can escalate to:

  • Privacy complaints — Office of the Australian Information Commissioner (OAIC), oaic.gov.au, 1300 363 992.
  • Consumer complaints / refunds — NSW Fair Trading, fairtrading.nsw.gov.au, 13 32 20; or the Australian Competition and Consumer Commission (ACCC), accc.gov.au.
  • Card payment disputes — your card issuer (chargeback). Please tell us about a chargeback in advance where you can; raising one without contacting us first may slow resolution.

17. Governing law and jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Any dispute that can't be resolved by negotiation or external resolution as in section 15 will be brought in the courts of New South Wales, and you submit to their non-exclusive jurisdiction.

18. General

  • Entire agreement. These Terms (with the Privacy Policy, any competition by-laws, and any written agreement between us) are the whole agreement between you and us about the Portal, and replace any earlier representations.
  • Severability. If any part of these Terms is unenforceable, the remainder still applies.
  • Assignment. You may not transfer your account or rights under these Terms to anyone else without our written consent. We may transfer our rights and obligations under these Terms to a related body corporate or to a buyer of our business with reasonable notice.
  • Waiver. If we don't enforce a right, that doesn't mean we've waived it.
  • Definitions. "Including" and "for example" do not limit what comes before; references to "writing" include email.
